To use 'compostable' on plastic packaging in France, EN 13432 (industrial composting at 60 °C, mixing, controlled moisture) is insufficient: Article L. 541-9-1 of the Environmental Code prohibits the wording on plastic that composts only in an industrial facility, excluding 'industrially compostable'. Only home-compostable plastic certified under NF T 51-800 may carry it, with the wording 'Do not litter'; without this evidence, 'home compostable' is unverifiable and therefore risky under EmpCo and the Consumer Code. EmpCo, applicable since 27 September 2026 but not yet transposed in France, further tightens the framework: a 'compostable' claim on a product whose final use gives no access to an industrial composting stream will be classed as a misleading commercial practice - because it misleads the consumer about the product's actual end of life.
